Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Wishey Telegram mini app, the @wishey_bot and @wishey_support_bot Telegram bots and the wishey.app website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Who operates Wishey
Wishey is currently operated as an independent project without a separate legal entity. References in these Terms to “we”, “us” or “our” mean the individual developer(s) maintaining the Service.
The Service is hosted on infrastructure located in Germany. We aim to comply with applicable laws, including where relevant the laws of the European Union (such as the GDPR). Where mandatory local laws grant you additional rights, those rights remain unaffected.
2. Description of the Service
Wishey is a Telegram mini app for making wishlists and coordinating gifts. It lets you:
- Create wishlists for birthdays, weddings, holidays and other occasions;
- Add wishes with a title, price, link to the item, comment and an icon or photo;
- Share wishlists by link, in any Telegram chat, or by creating them right in a group chat with the bot;
- Reserve gifts in other people’s wishlists so that the same gift is not given twice, and see all your reservations in one place;
- Choose whether you, as a wishlist owner, see which gifts are reserved and by whom;
- Receive notifications from the bot about events, new wishes and deleted reservations;
- Contact us through the support bot.
The Service is free of charge. It has no paid plans or advertising, and it does not sell goods, process payments or hold money. Wishes are only lists of ideas: any purchase you make happens outside the Service, directly with the store or seller of your choice.
3. Eligibility
You may use the Service only if:
- You are at least 16 years old; and
- You have a valid Telegram account and comply with Telegram’s own terms and policies.
By using the Service, you represent and warrant that you meet these requirements and that you have the authority to enter into these Terms.
4. Your account and Telegram
The Service uses Telegram’s mini app launch data for authentication. We do not issue separate usernames or passwords, so your access to the Service depends on your Telegram account.
Telegram is a separate service with its own terms, privacy policy and security practices. We are not responsible for Telegram.
5. Your content
Your content is everything you add to the Service: wishlist titles, descriptions and dates, wish titles, prices, links, comments and photos.
- You keep all rights to your content. You grant us a limited, non-exclusive, royalty-free license to store, process and display it only as needed to provide the Service — for example, to show your wishlist to the people you share it with.
- Anyone with the link to a wishlist that is not private can see its content (see our Privacy Policy). Share links only with people you trust, and do not put information in wishlists that you would not want them to see.
- You are solely responsible for your content. You will only upload photos you have the right to use, and you will not add content that is unlawful, abusive, defamatory, fraudulent, misleading or that infringes the rights of others.
- You will not add links to malware, phishing or other harmful websites, and you will not add other people’s personal data without the right to do so.
- We may remove content or restrict access to the Service if we reasonably believe it violates these Terms or the law.
6. Reservations, gifts and links
- Reservations are informal. Reserving a wish is a way to let others know you plan to give it. It is not a purchase, an order or a binding promise, and we do not guarantee that a reserved gift will actually be given.
- Prices are informational. Prices and currencies are entered by users and are not checked or converted by us. The actual price, availability and delivery of an item are determined by the store.
- Third-party websites. Links in wishes lead to websites we do not control. We are not responsible for their content, products, prices or practices, or for any purchase you make there.
- Deleted wishes. The owner of a wishlist can change or delete wishes at any time, including reserved ones. The bot notifies you when a wish you reserved is deleted, if you have that notification turned on, but we are not responsible for gifts bought before or after such a change.
7. Acceptable use
You must use the Service in a lawful and reasonable manner. You agree not to:
- Use the Service in violation of any applicable law or regulation;
- Use the bots to send spam or unsolicited messages, or add the bot to chats to disturb their members;
- Reverse engineer, decompile or attempt to derive the source code of the Service, except as permitted by law;
- Interfere with or disrupt the Service or its infrastructure;
- Attempt to gain unauthorized access to the Service, private wishlists, other users’ data or our systems;
- Upload malicious code or use automated tools (such as bots or scrapers) without our prior permission;
- Use the Service for fraud or other illegal activities.
8. Free service
The Service is currently provided free of charge, without advertising or paid features. If we ever introduce paid features or advertising, we will update these Terms and our Privacy Policy before they take effect, provide notice where reasonably feasible (for example, inside the mini app), and ask for your consent where the law requires it.
9. Intellectual property
All rights, title and interest in and to the Service, including its code, design, logos and other content (excluding your own content and third-party trademarks), are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial purposes in accordance with these Terms.
Telegram® and any other third-party names, logos or store names mentioned in the Service are trademarks of their respective owners. Use of such marks does not imply any affiliation with or endorsement by them.
10. Third-party services
The Service relies on third-party services, including:
- Telegram, which provides authentication, the mini app environment and the bots through which we send messages; and
- Hosting, database and object storage providers, which run the Service and store its data, including wish photos.
Those services are provided under their own terms and privacy policies, which we do not control. We are not responsible for any acts or omissions of such third parties.
11. Service availability and changes
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an “as is” and “as available” basis.
We may modify, suspend or discontinue all or part of the Service at any time, for any reason, with or without notice. Where feasible, we will try to provide reasonable notice of material changes.
12. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
In particular, we do not warrant that:
- Notifications and reminders will always be delivered or delivered on time;
- The Service will be secure, error-free or available at all times; or
- Data losses will never occur (for example, due to hardware failures or network issues).
To the extent permitted by law, we will not be liable for:
- Any indirect, incidental, consequential, special or punitive damages; or
- Any loss of profits, business, data or goodwill, including duplicate, unwanted or missing gifts,
arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your content;
- Your breach of these Terms; or
- Your violation of any rights of another person or entity.
14. Governing law and disputes
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of Germany, without regard to its conflict of laws principles.
If you are a consumer residing in the European Union, you may also have rights to bring claims in your country of residence under mandatory consumer protection laws. Nothing in these Terms limits those mandatory rights.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page and, where appropriate, provide additional notice (for example, within the mini app or via Telegram).
Your continued use of the Service after the updated Terms become effective will constitute your acceptance of them.
